  1. General Conditions
    The present terms and conditions of use apply to the eCultObservatory portal at www.ecultobservatory.eu, including all tools and services administered by eCultObservatory in connection with the eCultObservatory portal. In using the portal, tools or services, you commit to comply with the present terms and conditions of use.
  2. Intellectual Property Rights
    The eCultObservatory portal is based on the sharing and collaborative paradigm of Web 2.0. Thus, its content is open to the public according to the principles of Creative Commons non-commercial licence (www.creativecommons.org). Where content is clearly identified as subject to copyright by the use of the symbol ©, the rights of the copyright owner(s) remain applicable. This is equally valid for content linked up from the eCultObservatory portal. Where in doubt, please contact the eCultObservatory webmaster (william [at] emfs.eu) or the relevant copyright owner.
  3. Unauthorized Use and Practices
    Users shall refrain from: 
    • Inserting into eCultObservatory any insulting or defamatory contents; 
    • Inserting into eCultObservatory any pornographic materials or any content that violates any applicable legislation for the protection of minors; 
    • Using the portal as a medium for spam;
    • Employing any mechanisms, software or scripts other than interfaces or software provided by eCultObservatory itself when interacting with the portal; 
    • Obtaining unauthorised access and distribute or publicly disclose the restricted content that may be made available to closed user groups on the eCultObservatory portal; 
    • Performing any actions which may impair the operation of the eCultObservatory portal, particularly actions which may overload the portal infrastructure. 
  4. Personal information
    By filling-in the join us form and other interactive features of the portal, a visitor grants eCultObservatory permission to save his or her personal information for the purpose of automated user profiling, customer management, market research and direct mail. The information provided can be transferred for these purposes to companies contractually connected with eCultObservatory, but not to 3rd parties for commercial use. You have the right to review your relevant personal information and make corrections if applicable. You can direct your request to review, correct or oppose use of your information to: william [at] emfs.eu.
  5. Automatically collected non-personal information
    eCultObservatory may collect anonymous or aggregated information, such as browser type or IP address, the operating system you use or domain name of the website from which you visited the eCultObservatory portal or to which you go when you leave eCultObservatory portals.
  6. IP addresses
    When a message is posted to the comments, the poster’s IP address may be displayed. Sometimes the IP address of a proxy server may also be visible in brackets. The purpose of this is to increase the authenticity and integrity of messages by preventing people from posting messages under someone else’s name. In the event of complaints about intended unlawful behaviour, this IP address may be communicated to the law enforcement authorities.
  7. Links to other websites
    The eCultObservatory portal may contain hyperlinks to websites or web pages of third parties or other parties, or refer to them in some other way. eCultObservatory has no control over the content or other features of these websites or web pages and cannot be held liable in any way for the content or features thereof. eCultObservatory’s use of links does not in any way constitute implicit approval of the content of these websites or web pages.
  8. Passwords and secure areas of the portal
    Users need a password to access certain restricted areas of the eCultObservatory portal. Entering these areas without a password is strictly prohibited. Once you have received such a password, you must keep this password secret and confidential. Each use of eCultObservatory made after valid identification using your password shall be deemed to be committed by you. If eCultObservatory has reason to believe that the safety of the site is in jeopardy, eCultObservatory can delete your account.
  9. Disclaimer
    eCultObservatory is a result of eCult Value, a project co-funded by the FP7 Programme of the EC. However, the content of the eCultObservatory portal does not reflect the views of the European Commission. The information, software, products and services that are offered on the eCultObservatory portal may contain shortcomings of all kinds. eCultObservatory does not warrant for them in any way. The information is supplied and presented without any form of guarantee. eCultObservatory shall not be liable for possible viruses and rejects all liability for any damage these viruses may cause.
  10. Applicable legislation and competent courts
    eCultObservatory portals are governed by the laws of Belgium. In the event of disputes, the courts of Brussels (Belgium) have sole jurisdiction.
